This is all over several news sites, I saw it come up many times on
the Yahoo headlines page and the Car & Truck links page. (Most of
them said it was only $8 billion, but what's an extra billion here, or
a billion there to these guys?)
I get the impression that Kerkorian is just looking for them to refund
his investment losses (sorry, no guarantees in investing). If he gets
his money back but the courts refuse to order the reversal of the
merger, where is DC going to come up with the $8 billion to pay this
guy? The same place they've gotten the cash for all of their recent
takeover bids, by pulling it out of Chrysler's reserves and operating
budget. Then they'll complain even more about how the Chrysler group
isn't contributing to their bottom line.
I think this article is worth reading to understand DC's operational
policy in regards to the Chrysler group:

If you don't want to read the whole thing, look for the part where he
poses the questions "So why isn't Chrysler making as much money as
usual this year?" and "So what happened to the money?"
Overall, I think this lawsuit is a pretty risky situation for
Chrysler. I can see the potential to be either really, really good,
or really, really bad. (I'm the first to admit that I don't
understand big buisness at all, hopefully there's a lot more to it
that I'm missing and it really is a good thing).
