The notes thing is very important. I had a dispute over a $400
cancellation charge for an engine replacement last fall. I put a deposit
to hold my spot for the following week so I would be without the truck for
a short a time as possible. Well I was going to have headers put on at the
same time. I bought the MP headers and they were full length not shorties
as I anticipated, so I stopped by to ask if they can do those to or if I'd
have to take it to an exhaust shop. There were like 4 guys there with oil
leaks in their newly replaced engines. One guy had an appointment with the
manager at 12:00, it was almost 1 when I was there and still no manager. I
decided to stay away from Neco, so I went back to work and cancelled my
appointment. The manager saw no problem with me gettin back my $1200
deposit. Well corporate decided that there was a 15% fee on all cancelled
orders as a restocking fee. I was like WTF... so i still cancelled the
appt and made a ton of phone calls but noone would let me talk to their
boss, and everyone was rude as can be, I'm sure I was too it was my
vacation that I was dealing with this on. So i called the RI attorney
general and he said we'll see what we can do, great, the local guy
basically said we have no say in this you have to deal with corporate, in
New Hampshire. Well now my RI attorney General was useless. So I
contacted the NH BBB. They got the story of well it is RI's choice. I
said fine, this is already 3 months later. The RI attorney General said
that if i did not get my $400 back he was going to set up a court date for
me and give me one of the state lawyers as there was no mention of a
restocking fee anywhere, not even on the "contract" I signed. So basically
they said make the court date until they found out I was keeping records of
everything, phone conversations, who said what, what their tone was,
etc. It took 4 months but I finally got my check back. The moral, never
step down, if you do deserve it rightfully get it. Good luck with your
dealer case it sounds like you are all set.
