The rubber flap is all the way up just behind the grill. It covers up some
AC plumbing, and is kinda flexy like floor mats. Not all Daks are coming
with the flap, so it's possible it's not there.

As for that snorkel I usually recommend pulling it out of the box (can be a
pain in the ass). That way the box receives cold air quickly from the grill
when you move. Someone will argue with me that it draws hot engine air in
that way, but trust me as soon as you go above 5mph, the air is cooler. I
have temperature probe data to back that up.

Also if I had a stock box I'd try to figure out how to replace that
accordion looking rubber connection between the air box and air hat. Being
full of ridges must reek havoc on air flow. Try to get a internally smooth
tube from somewhere.
