If the safety restraint system has been modified to the point of disabling
any part of the system - you're probably not going to win in court.
I had asked a State Trooper on my 4-point harness (still have the factory
system installed though) and if wearing it was "legal"...he stated "No".
However, he did admit that he would rather be wearing a 4 or 5-point system
(if properly installed) than the lap/shoulder system (it's just safer).
Mine is properly installed with the correct grade bolts and a steel (1/4"
thick) plate under the truck with the proper washers and bolts as well.
Still...if I wear it and am caught under the "Click It or Ticket" program
now running...i'll be receiving a ticket - no questions, no excuses.
Wonder what they do when someone in an early 60's vehicle (with only a
lapbelt) gets pulled over though....

Don't know about a law, but eversince the shoulder harness has been
installed on vehicles it has been considered inproper use of the seat belt
to not use the shoulder harnes. In fact it is illegal to remove the
shoulder harnes in a vehicle originally equipped with the shoulder harness.
In a veihicle that never had the shoulder harness you would be able to fight
it no problem. Other than that I'd say it depends on the mood of the judge.
Honestly the shoulder harness should be used, they do make additional
attachments the can be put on the belt to adjust the height so it does not
cut acrros the neck for shorter people. Not sure if it would work for you
or not. These are in the automotive section of K-Mart and Wally World. Good
