Naw. If he pulled out in front of you while oyu were going 50 and you hit
him smack on. it's HIS fault. This happened to my friend.
He waas doing about 50 in a 45 and this landscape truck pulled out in front
of him and he rear ended the guy...
Later, the guy that was rear ended was ticketed and HIS (landscape guy's)
insurance had to pay for both accidents.
I'd fight that in court. Why didn't you TELL the cop on the scene that he
pulled out in front of you. It's not that hard (should be too hard) to
prove he did. You can win this case. Don't get your rates jacked up
because of his stupidity.
NOW... one other thing is that you did have adequate time to stop, just
drop the whole thing, let the insurance handle it because there isn't
anything you can do, unless you hire a REALLY darn good lawyer.
