Ebay has safe harbor. Its a free service that will try to work things out
with the seller. I think if the matter is not resolved with emails from safe
harbor you can pay for legal assistance with safe harbor. Check out Ebay
services. Also, you can file mail fraud charges with the post office. He
used the US mail to take your money, check with your local post office or on
the web.

I use safe harbor once, purchased a 1/9 scale drag bike for 100.00. paid guy
never sent product. safe harbor sent him afew emails and finally after 6
months i received my drag bike.
